3-YEAR LIMITED WARRANTY (1 YEAR PLUS 2-YEAR EXTENSION)

1-Year Limited Warranty OASE Floating Fountains and Aerators are covered by a 1-year limited warranty by OASE. The Limited Warranty period begins from the date of installation and covers material and manufacturing defects or failure of the product to operate as specified by OASE during the limited warranty period.

This Limited Warranty does not cover failure or problems related to: Improper installation – see the instruction manual that came with the product for proper installation procedures. Any modification or repair of the product other than by an OASE trained and authorized repair technician. Failure to follow proper safety, care and maintenance guidelines - as outlined in the instruction manual that came with the product. Failure to follow cable gauge requirements, or use of inappropriate grade of cable for the application. This Limited Warranty also does not cover those parts of the product that are subject to normal wear and tear during usage of the product, such as light bulbs, impellers and propellers on pumps. OASE’s  sole liability shall be to replace or repair the product covered by this limited warranty. OASE shall not be liable for any costs
associated with the repair or replacement of OASE products by anyone other than OASE or an OASE Service Center, unless prior written approval has been obtained from OASE. OASE shall not be liable for any consequential damage to any other part of the pond, water feature, landscape, structure, or the contents of any structure where the product is located or used – including no liability for damage or harm to fish, animals, or plants in or around the water garden, pond or water feature.

THE EXPRESS WARRANTIES SET FORTH HEREIN ARE THE ONLY WARRANTIES WITH RESPECT TO THE PRODUCTS, AND THE REMEDIES SET FORTH HEREIN ARE THE EXCLUSIVE REMEDIES IN THE EVENT OF A BREACH OF SUCH WARRANTIES. OASE EXPRESSLY DISCLAIMS ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. OASE SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES FOR INCIDENTAL OR CONSEQUENTIAL

DAMAGES OF ANY NATURE, FOR ANY BREACH OF SUCH WARRANTIES OR OTHERWISE.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you. Should your OASE product be defective or fail under the terms of this Limited Warranty, please contact OASE  information regarding in-field examination/repair or for a Return Goods Authorization (RGA) number. Do not return the product to OASE without having contacted OASE first. If you are instructed to return the product to OASE for examination/repair, you should follow the shipping instructions given to you by OASE and make sure you put the RGA number on the shipping documents to OASE. Either an authorized OASE service technician or OASE will be the sole determinant as to whether the failure or defect is covered by the Limited Warranty. If it is not, you will be advised of what is involved in the repair so that you can either authorize OASE to do the repairs or have the product returned to you for your own repair. 2-Year Limited Warranty Extension Please fill out the OASE Limited Warranty Registration Card that comes with the product to get a 2-year extension of your limited warranty. Once your registration information has been received by OASE you will receive back by post or email a Limited Warranty Extension Certificate, which you should print out and keep with your original receipt of purchase.

Delivery Estimates: If delivery estimates are given, they are made in good faith based on information from the customer but may be subject to delays due to government restrictions, failure of a supplier to deliver to OASE, fires, strikes, or acts of God.
 

Packaging: All shipments will be made in packaging materials that have been approved by domestic carriers.

Missing Items: Missing or noticeably damaged items must be signed for as missing
or damaged at time of delivery. Shipments will be considered complete unless receiver notifies OASE of any missing items within 5 days of receipt of goods. No credit for missing items can be applied against any invoice without prior approval of OASE.

Return Policy: No products should be returned to OASE without a Return Goods Authorization (“RGA”) number. The RGA number must be clearly written on all packaging and paperwork. Items shipped to OASE without an RGA will be refused upon delivery. All returned items will be subject to inspection and testing. Items should be returned complete with all parts or the account may be charged for missing parts at invoice price. Final determination of defect and warranty status will be made by OASE. All approved warranty returns will be settled by credit memo or in-kind replacement.

Other Conditions: OASE reserves the right to redesign, alter or modify its products at any time. The laws of the State of California apply. State and local laws regarding commercial credit, interest and late charges vary widely. The Federal usury preemption laws currently in effect will apply to all transactions.

Freight Terms:

All sales FOB OASE, Corona, CA, USA
Freight charges will not be added to the invoice on single shipment on products: $10,000 or more, list price before discounts .

Drop Shipments: will have a $25 Service Charge added to the invoice. (ComNur covers this cost on complete systems)

Will Call orders receive a 2% discount on 50% of list price. Orders must be prepaid., Allow necessary time for OASE to prepare your order They can be picked up in Corona, CA, USA between 8am and 4pm, Monday through  Friday.


Minimum Orders Our minimum order is $100 (net after applicable discounts).
For any order under $100 there will be a $15 Service Charge added to the invoice.
